MVBEO moves to next stage

The UK Competition and Markets Authority (CMA) have circulated their draft legislative proposal concerning revisions to the current Motor Vehicle Block Exemption Regulation (MV-BER). The Secretary of State is likely to accept all recommendations by the CMA on the revised MV-BER to create a new UK Motor Vehicle Block Exemption Order (MVBEO).

The CMA has said that “the new Motor Vehicle Block Exemption Order (MV-BEO) should be tailored to meet the specific needs of UK businesses and consumers and reflects the board consensus of responses to its original consultation".

IAAF & UK AFCAR broadly welcomes the top-line revisions contained in the draft of the MV-BEO. A key issue of the previous legislation was lack of enforcement of the regulation and its impact, particularly at garage level and the draft does not contain any revisions to the guidelines that will accompany the MV-BEO. We are only at the beginning of a long journey that seeks to ensure consumer choice – and the ability for the aftermarket to compete – is protected.

The IAAF will respond to this draft MV-BEO before the deadline for feedback on 1st March.

The order will come into effect from 1 June 2023 and will remain in force for five years.
