USA - Right to Equitable and Professional Auto Industry Repair (REPAIR) Act

On 2nd February, the “Right to Equitable and Professional Auto Industry Repair (REPAIR) Act” was introduced to the US Congress, as the result of the efforts of the Automotive Aftermarket Suppliers Association (AASA) and Auto Care Association – and a wave of industry support. The bill was developed to ensure consumer choice and to safeguard a free and fair repair market.

This draft legislation includes features such as access to in-vehicle data and cybersecurity requirements close to the ones FIGIEFA is currently pushing for at EU level. It also includes several MVBER-like provisions, such as access to technical information and tools and the possibility to use independent replacement parts. This confirms that the challenges for the aftermarket sector exist worldwide and require adapted legislative solutions.

In terms of next steps, the draft bill still needs to be co-sponsored so that it gets a hearing and eventually a vote. On the executive side, Joe Biden’s administration has repeatedly expressed its support for greater competition for the provision of everyday’s services to American households, and in particular for the automotive sector. A precise legislative calendar is however not yet available.
